1. Use of this website

You may use this website provided that you do not:-

a)    Re-publish, reproduce or store material from this website in any public or private electronic system;

b)    Reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our website or material on our website for commercial purposes;

c)     Edit or otherwise modify any material on the website.

Under certain specific circumstances, Arthistorical Ltd. may permit some relaxation of the above. Requests should be sent to us by email to stephen@arthistorical.com.

2. Online Content

Whereas Arthistorical Ltd. ["the company"] takes care to ensure that the information on this website is accurate, it assumes no liability for the topicality, correctness, completeness or quality of the information provided and cannot be held liable for any loss or damage resulting from information given or withheld.

All content is subject to change without notice and is non-binding. The company expressly reserves the right to modify, supplement or delete parts of the pages or the entire content without prior advance notice, or to suspend or terminate publication.

3. Condition reports

In the descriptions of our items, we do not give information about condition. Prospective buyers need to make specific enquiries regarding condition, and, where possible, we will provide a brief condition report. Whilst given in good faith, our condition reports are for guidance only and should not be relied upon for the justification of a purchase. For a more detailed condition report, prospective purchasers should, where appropriate, employ their own independent advisor or restorer.

4. Anti-Money Laundering Regulations

i. From 10th January 2020, any dealer who sells art valued at €10,000 or more will be required to carry out due diligence on the customer making the purchase. Customer Due Diligence or ‘Know Your Customer’ is about knowing who your actual customer is and collecting evidence to verify their identity. It also includes checking whether the customer appears on sanctions/high risk lists, is politically exposed or whether any ‘Red Flags’ are raised, for example if there are any doubts about the information provided by a customer or if any aspect of a transaction appears to be suspicious.

ii. Therefore, if you are a private buyer, you agree to provide a) a copy of a valid government-issued photo ID (e.g. a passport, driving licence or identity card), and b) a copy of a recent utility bill, for example water or electricity, within the last 3 months and showing your permanent residential address.

iii. If you are a company, you agree to provide a) a copy of the business’s certificate of incorporation or equivalent document, and b) identification documents of the company’s immediate and ultimate beneficial owner(s) (i.e. those owning 25% or more of the company’s shares).

iv. If you are buying as agent for a third party, you must a) disclose that you are acting an an agent, and b) provide us with the identification documents for yourself and the third party, the latter of which we will use only for the purposes of compliance with the AML Legislation.

v. Any personal data obtained by us will be used solely for the purposes of complying with the AML Legislation.

5. Privacy Policy

Arthistorical Ltd. is committed to safeguarding and preserving the privacy of our visitors. This Privacy Policy document (the "Policy") is based on a template provided by the legal resource DIY Legals and reviewed and approved by their solicitors.

This Policy explains what happens to any personal data that you provide to us, or that we collect from you whilst you visit our site.

We do update this Policy from time to time so please do review this Policy regularly.

i. Information That We Collect

In running and maintaining our website we may collect and process the following data about you:

a) Information about your use of our site including details of your visits such as pages viewed and the resources that you access. Such information includes traffic data, location data and other communication data.
